Terms & Conditions

1. Acceptance of Terms

By downloading, installing, or using the Bookula mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the App.

You must be at least 13 years of age to use the App (or 16 in certain European jurisdictions, consistent with our Privacy Policy). By using the App, you represent that you meet this age requirement.

2. Description of Service

Bookula is a platform that allows users to create groups, share their personal book collections, and borrow physical books from other members within those groups. The App is intended for personal, non-commercial use only.

Bookula facilitates connections between users but is not a party to any lending or borrowing transaction between them. We do not own, inspect, or take custody of any books exchanged through the App.

3. User Accounts

You must create an account to use Bookula. You agree to:

  • Provide accurate, current, and complete information during registration and keep it updated.
  • Maintain the confidentiality of your account credentials and not share them with any third party.
  • Accept responsibility for all activities that occur under your account, whether or not authorized by you.
  • Notify us immediately at support@bookula.app if you suspect unauthorized access to your account.

Bookula is not liable for any loss or damage arising from your failure to maintain account security.

4. User Responsibilities

Book Care & Returns

  • You agree to treat borrowed books with care and return them in the same condition as received, subject to normal wear.
  • If a borrowed book is damaged beyond normal wear, lost, or not returned within the agreed timeframe, you are solely responsible for resolving the matter directly with the lending user.
  • You agree to report any pre-existing damage to a book before accepting a borrow to avoid disputes.

Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Post offensive, defamatory, misleading, or inappropriate content, including in book descriptions, group names, or messages.
  • Use the App to send spam, unsolicited messages, or promotional content to other users.
  • Attempt to scrape, harvest, or collect data from other users without their consent.
  • Reverse engineer, decompile, or attempt to extract the source code of the App.
  • Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.
  • Use the App to facilitate any commercial transaction, including reselling or renting books for profit.

5. User Content License

By submitting content to the App — including book titles, descriptions, profile information, group names, and messages — you grant Bookula a limited, non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content solely for the purpose of operating and improving the App.

You retain full ownership of any content you submit. This license terminates when you delete the relevant content or your account, subject to the message retention terms described in our Privacy Policy.

You represent that you have the right to submit any content you post and that it does not infringe the intellectual property or other rights of any third party.

6. Physical Book Disclaimer

Bookula is a technology platform that facilitates peer-to-peer book lending. We are not responsible for:

  • The physical condition of any book lent or borrowed through the App.
  • The loss, theft, or non-return of any book by any user.
  • Any dispute between users regarding book condition, return timelines, or borrowing agreements.
  • The accuracy of book descriptions or listings posted by users.

All lending and borrowing arrangements are agreements solely between the users involved. We encourage users to communicate clearly about expectations before exchanging books.

7. Intellectual Property

All content, design, trademarks, and software within the Bookula App — excluding user-submitted content — are the property of Bookula and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sublicense, or reverse engineer any part of the App without prior written consent from Bookula.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

  • The App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Any defects will be corrected.
  • Third-party services integrated into the App (including Supabase and Firebase) will be continuously available or error-free.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Bookula and its operators shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of, or inability to use, the App or its services — including but not limited to loss of data, loss of books, or disputes between users.

To the extent Bookula has any direct liability, it shall not exceed the greater of (a) the total amount you paid to use the App in the 12 months preceding the claim, or (b) $10 USD.

Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law in your jurisdiction.

10. Indemnification

You agree to indemnify, defend, and hold harmless Bookula and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the App or violation of these Terms.
  • Your interactions with other users, including any book lending or borrowing disputes.
  • Any content you submit to the App that infringes the rights of a third party.

11. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice in cases of serious or repeated violations.

Upon termination:

  • Your access to the App will be revoked immediately.
  • Any active borrowing requests you have initiated will be cancelled. You remain responsible for returning any books currently in your possession to their owners.
  • Your data will be handled in accordance with our Privacy Policy.

You may delete your account at any time through Settings > Delete Account. Voluntary deletion does not release you from obligations to return borrowed books or resolve outstanding disputes.

Bookula may, at its sole discretion, reinstate a terminated account if the circumstances warrant it.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. For users in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence also apply and are not affected by this clause.

13. Dispute Resolution

If you have a dispute arising from these Terms or your use of the App, please contact us first at support@bookula.app. We will make reasonable efforts to resolve the matter informally within 30 days.

If the dispute is not resolved informally, either party may pursue available legal remedies in a court of competent jurisdiction in the State of Delaware, or in your country of residence if required by applicable consumer protection law.

EEA and UK users may also submit complaints to their local consumer protection authority or data protection supervisory authority at any time, regardless of whether informal resolution has been attempted.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or applicable law. For material changes, we will provide at least 30 days' advance notice by posting the updated Terms within the App and sending an email to the address associated with your account.

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the App and may delete your account.
